INFORMATION ABOUT COOKIES
In accordance with Law 34/2002 of 11 July on information society services and electronic commerce (LSSI), in relation to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, General Data Protection Regulation (GDPR) and Organic Law 3/2018 of 5 December on Data Protection and the Guarantee of Digital Rights (LOPDGDD), it is mandatory to obtain the user’s express consent on all websites that use non-essential cookies before the user browses them.
WHAT ARE COOKIES?
Cookies and other similar technologies, such as local shared objects, Flash cookies or web beacons, are tools used by web servers to store and retrieve information about their visitors, as well as to ensure the website functions properly.
The use of these devices enables the web server to remember certain details about the user, such as their preferences for viewing the server’s pages, their username and password, the products they are most interested in, etc.
COOKIES AFFECTED BY THE REGULATIONS AND COOKIES EXEMPT FROM THEM
According to the EU Directive, the cookies that require the user’s informed consent are analytics cookies and advertising and affiliate cookies, with the exception of technical cookies and those necessary for the functioning of the website or the provision of services expressly requested by the user.
TYPES OF COOKIES
Depending on the purpose
- Technical and functional cookies: are those that enable users to navigate a website, platform or application and to use the various options or services available on it.
- Analytical cookies: are cookies that enable the controller to track and analyse the behaviour of users on the websites to which they are linked. The information collected through these types of cookies is used to measure the activity on websites, apps or platforms and to create user profiles for these sites, apps and platforms, with a view to making improvements based on an analysis of how users interact with the service.
- Advertising cookies: are those that enable the most effective management of any advertising space that the publisher may have included on a website, app or platform through which the requested service is provided, based on criteria such as the content published or the frequency with which the adverts are displayed.
- Behavioural advertising cookies: collect information about the user’s personal preferences and choices (retargeting) to enable the most effective management of any advertising space that the publisher may have included on a website, app or platform through which the requested service is provided.
- Social media cookies: are set by social media platforms on the services to allow you to share content with your friends and networks. Social media platforms are able to track your online activity outside the Services. This may affect the content and messages you see on other services you visit.
- Affiliate cookies: these enable the tracking of visits originating from other websites with which the website has an affiliate agreement (affiliate companies).
- Security cookies: store encrypted information to prevent the data stored in them from being vulnerable to malicious attacks by third parties.
According to the property
- First-party cookies: are those sent to the user’s device from a server or domain managed by the website operator itself, from which the service requested by the user is provided.
- Third-party cookies: are those sent to the user’s device from a server or domain that is not managed by the website operator, but by another entity that processes the data obtained through the cookies.
Depending on the shelf life
- Session cookies: are a type of cookie designed to collect and store data whilst the user is accessing a website.
- Persistent cookies: are a type of cookie in which the data remains stored on the device and can be accessed and processed for a period defined by the cookie issuer, which can range from a few minutes to several years.
